These Terms and Conditions (“Terms”) govern your access to and use of the Enaqd platform available at https://startup.enaqd.exchange (the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Nature of the Platform

Enaqd is a technology and user-interface platform only.

Enaqd does not:

  • act as a bank, custodian, exchange, broker, or payment service provider
  • provide regulated financial services
  • execute, settle, or process transactions
  • hold, control, or manage user fiat or digital assets

The Platform is designed to connect users with licensed third-party service providers for financial or digital asset services.

3. Third-Party Services

Any financial, payment, fiat-to-crypto, or crypto-to-fiat services made available through the Platform are provided entirely by third-party partners.

Users contract directly with those third-party providers, and such services are governed by the providers’ own:

  • terms and conditions
  • privacy policies
  • regulatory obligations

Enaqd is not responsible for the availability, performance, compliance, or outcomes of third-party services.

4. No Custody of Funds

At no point does Enaqd:

  • receive user funds
  • store crypto or fiat
  • control private keys
  • intermediate settlement

All funds and assets are handled exclusively by licensed third-party providers.

5. Eligibility

You confirm that:

  • you are legally permitted to use the Platform under applicable laws
  • you are not located in a jurisdiction where use of the Platform is prohibited

Enaqd does not guarantee availability in all jurisdictions.

6. Platform Availability

The Platform may be updated, modified, suspended, or discontinued at any time without notice. Enaqd does not guarantee uninterrupted or error-free operation.

7. Limitation of Liability

To the maximum extent permitted by law, Enaqd shall not be liable for:

  • losses arising from third-party services
  • transaction execution or settlement failures
  • regulatory actions taken by third-party providers
  • indirect, incidental, or consequential damages

8. Intellectual Property

All content, branding, and software on the Platform are the property of Enaqd or its licensors and may not be used without prior written consent.

9. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.
